Appeals Court Rules Against Trump in Birthright Citizenship

GREENSBORO, N.C. — The Appeals court rules against Trump in birthright citizenship battle, marking another major legal setback for the former president’s immigration agenda. On Friday, the First Circuit Court of Appeals upheld a lower court’s injunction blocking the Trump administration from enforcing an executive order that sought to end birthright citizenship in the United States.

The three-judge panel in Boston ruled that the administration’s attempt to limit citizenship to children of U.S. citizens and legal residents was unconstitutional, reaffirming that anyone born on U.S. soil is automatically a citizen — regardless of parental immigration status.

“The lessons of history give us every reason to be wary of blessing this most recent effort to break with our established tradition of recognizing birthright citizenship,” the court wrote in its 100-page opinion.

This decision adds to a growing number of federal rulings against the former president’s efforts to reinterpret the 14th Amendment, which guarantees citizenship to “all persons born or naturalized in the United States.” The Appeals court ruling against Trump in birthright citizenship battle is the fifth such decision since June to either issue or uphold orders blocking the policy.

California Attorney General Rob Bonta, who led one of the lawsuits challenging the order, praised the court’s decision. “Today’s decision upholds a nationwide injunction in our lawsuit challenging the President’s attempt to end, with the stroke of a pen, the constitutional right to birthright citizenship,” Bonta wrote on X. “We will continue to oppose this executive order until the President’s attempt to unmake the Constitution is blocked completely.”

The Justice Department has since petitioned the U.S. Supreme Court to review the constitutionality of Trump’s executive order. For now, the ruling ensures that birthright citizenship — a cornerstone of American identity since the Reconstruction era — remains intact.
