President-elect Donald Trump has requested the Supreme Court to postpone the implementation of the controversial TikTok ban, currently set for the day before his inauguration. This delay, Trump argues, would allow him to personally negotiate a resolution addressing both national security concerns and the platform’s future in the United States.
Supreme Court to Hear TikTok Ban Challenge
The Supreme Court is already scheduled to hear oral arguments on TikTok’s challenge to the ban on January 10. The platform’s China-based parent company faces a looming deadline to divest ownership or risk a nationwide ban. Trump, however, believes that delaying the ban would eliminate the need for a judicial decision.
D. John Sauer, one of Trump’s appellate attorneys and nominee for U.S. solicitor general, stated that Trump’s unique expertise in dealmaking and foreign policy positions him as the ideal leader to address this issue. “President Trump alone possesses the deal making expertise, electoral mandate, and political will to negotiate a resolution to save TikTok while safeguarding national security,” Sauer wrote.
TikTok Ban: Trump’s Campaign Promise
During his campaign, Trump publicly opposed the TikTok ban and promised to protect the platform. Although specifics of his plan remain unclear, his legal team emphasized his history of achieving policy breakthroughs through negotiation.
TikTok’s legal arguments have also highlighted Trump’s interest in resolving the matter, describing him as one of the most influential social media users in history. The company believes the trajectory of the ban could shift under Trump’s leadership.
